The eligibility criteria for FSSAI license and registration are predefined as per the Food safety and standard Act, 2006 and regulations 2011.

Petty FBOs with annual revenue of less than Rs. 12 lakh are eligible for FSSAI basic registration as per the guidelines of the Food safety and standard Act.

Food business operators with a revenue of more than Rs. 12 lakh and under Rs. 20 crore per annum is directed to have an FSSAI State license in Mumbai.
3-star hotels and food service businesses
Cold storage units with a storage capacity of up to 10,000MT
Distributors with annual revenue upto Rs. 20 crore
Restaurants with annual revenue of not more than Rs. 20 crore
Manufacturing or processing units with capacity upto 1MT - 2MT per day
Criteria for allocating a central license rely on the nature of the FBO, and revenue. FBOs with annual revenue of more than Rs. 20 crores or functioning in more than one state need an FSSAI central license as per the guidelines.

As per the FSS guidelines the registration & license fee for FSSAI is classified into 3 classes.
For basic registration fee would be 100₹ per annuam
For State license it would range from 2000-5000₹ each year
For central Fssai food license is 7500₹ + 18% GST annually

Note : As per the new norm of FSSAI. The applicants are required to pay only Initial fee of ₹1000 + 18% GST on it for their FSSAI licenses. However once the application is processed and passed by the licensing authorities then the rest of the differential amount i,e respective license fee along with differential GST has to be paid by the applicant within 30 working days. If the applicant failed to pay the amount then approval will be auto rejected.

Validity and Renewal of FSSAI registration
The maximum validity of FSSAI registration or license is of 5 years and a minimum of 1 year.
Food business operators must apply for license renewal 180 days before the date of expiry.
The FSSAI license will be considered null and void after the date of expiry and all the work should be suspended with immediate effect as per the guidelines.
FBOs filing for renewal from the 1st-90th day after the expiry date shall be charged 3 times more than the annual fee and from the 91st-180th day, FBOs shall be charged 5 times more than the original annual fee.

FSSAI penalties in Mumbai
According to the Food Safety and Standards Act, 2006, the following penalties have been laid out for non-compliance with FSSAI in Gurgaon.
Selling deficient food items: if any FBO in Mumbai is found selling, manufacturing, or in a possession of food items that are considered non-consumable for humans as per the ordinance of FSSAI, then such FBOs are accountable for a fine, of not more than Rs. 1 lakh.
Contamination of food products: As per the FSS rules 2011 and guidelines, adulteration of food is a criminal act, and any person found indulging in such conventions shall be fined up to Rs. 10 lakh.
Unsanitary manufacturing condition: In the preparation of any kind of food, personal hygiene and the cleanness of the premises are the most important factor; hence FSSAI has guidelines for hygiene and cleanness of manufacturing place, and any FBOs found in violation of these rules are liable to fine of not more than Rs. 1 lakh as per the Act.
