FSSAI registration is mandatory for all kinds of food business operators in India as per the regulations set by the Food safety and standard authority under the FSS act, 2006. As per the guidelines no food business operator can commerce in food articles without having a valid FSSAI license and registration.

The documents required to get an FSSAI registration or FSSAI License vary as per the nature of licensing. Food business operators must apply according to their eligibility and submit all the necessary documents online through the FosCos portal.

Eligibility for FSSAI Registration and License

According to the FSS act, 2006. The eligibility for FSSAI registration is sub-categorised into three types based on the nature of food business operators as follows:-

FSSAI Registration Eligibility

FSSAI registration is a Basic license offered by India's Food safety and standard authority to all the food businesses involved in small-scale business.

These are the following businesses covered under FSSAI BASIC Registration offered by FSSAI licensing authorities:

  • FBO with a turnover of not more than Rs. 12 lakh annually
  • Street food vendors such as junk food stalls
  • Hawkers
  • Small-scale dairy units
  • Individual food manufacturers and seller

FSSAI License Eligibility

Criteria for FSSAI license are further sub-classified into 2 types based on the nature of FBOs

1. FSSAI State license

Any FBOs involved in large-scale food production, manufacturing, processing or transportation having an annual turnover between Rs. 12 lakh to Rs. 20 crore must have a valid FSSAI state license from the state licensing authorities.

These are the following FBOs who are also required to have a state license:

  • Traders
  • Marketers
  • Wholesalers
  • Slaughter-houses have the capacity for large animals up to 3 to 50 and Small animals upto 11 to 150

2. FSSAI central license

FBOs operating in more than one state or having an annual turnover over Rs. 20 Crore are required to have FSSAI central license from the authorities.

Such as;

  • Foreign food outlets like MacDonald’s
  • FBOs operating at central government premises
  • Food import-export merchants and manufacturer exporters
  • Food manufacturer with multiple units in more than one state

Documents required for FSSAI Registration

  1. Form IX is mandatory
  2. Identity proof of FBO owner
  3. Address proof is required
  4. Form-A must be duly filled and signed
  5. Ownership proof of premises
  6. Other supporting documents, if required, such as NOC by Municipality/Panchayat
  7. Source of the raw materials
  8. Water test reports in case of water used as an ingredient

Following documents are required for FSSAI State License

  1. Form-B should be duly completed and signed
  2. The detailed layout of the plant should be in meters
  3. Details of directors and partners of the firm
  4. In case of partnership firm certificate of incorporation is required
  5. Name and list of machinery and equipment
  6. Proof of ownership of premises or no objection certificate from the owner if rented
  7. List of food products that are to be manufactured (in case of the manufacturer)
  8. Chemical and bacteriological analysis report of water in case it is being used as an ingredient
  9. A recall plan is necessary
  10. Form IX submission
  11. No objection from a local municipality
  1. Copy of certificate acquired under COOP-Act
  2. A Company incorporation certificate is required
  3. A food recall plan is required
  4. In case of manufacturers list of food products that are to be manufactured
  5. No objection certificate from the ministry of tourism is required
  6. The import-Export code issued by DGFT is necessary in case of importers and exporters of food articles
  7. For 100% EOU certificate from ministry of commerce is needed
  8. Form IX
  9. Form-B duly be filled and signed
  10. Proof of ownership of premises
  11. Detailed layout of the plant

FSSAI license renewal

Validity & Renewal of FSSAI registration in Chennai

The renewal of the FSSAI license is equally important as getting a new registration. FBOs Can only renew the FSSAI license within the validity period itself.

  • FBOs can file for license renewal 120-30 days before the expiry date.
  • If any FBO files for license renewal after 30 days, before the date of expiration of the License, then a late fee of Rs. 100 per day Shall be charged as per the FSS guidelines.
  • FBOs can also file for express renewal 180 days before the expiry of their license if authorities open the express renewal window.
