There are mainly two broad types of pollution NOC in India. These clearances may be further divided across four distinct categories:

• Consent to Establish is an initial permission provided to those businesses whose manufacturing process and proposed plans meet all the required safety norms for environmental protection.
• Consent to Operate is a final clearance approved to manufacturing units to start commencing operational and production activities.

The processing timeline to receive a pollution NOC in India takes approximately 30-120 days.

As per the MoEFCC Consent Guidelines enforced in 2025, the government has proposed the Uniform Consent Guidelines notified under the Air (Prevention and Control of Pollution) Act, 1981, and the Water (Prevention and Control of Pollution) Act, 1974 to streamline the consent mechanism for industries operating across all States and Union Territories.

The main purposes are:

• To reduce procedural delays and strengthen environmental governance.
• To maintain a uniform framework for granting, refusing, and cancelling CTE and CTO.

• Reduces multiple applications, extended timelines, and strengthens provisions for monitoring, compliance, and cancellation.

Set renewal incentives: a 5% fee rebate for CTO renewal is applied for at least 4 months before expiry. The late fees may escalate from 25% to 100% of the consent fee depending on the delay.

It is not required to renew a Consent to Establish, as it’s a one-time construction approval required before constructing a premises. Occupiers must renew a CTO in India. Here are the steps given below:

• Step 1: Access Portal — Navigate to the State Pollution Control Board, also known as the Online Consent Management and Monitoring System Portal. Enter the existing credentials to create an account.
• Step 2: Renewal Application — Submit Form II to the State Pollution Control Board through the Online Consent Management & Monitoring System (OCMMS) portal.
• Step 3: Upload Documents — Attach an old license copy of consent, compliance report, environmental monitoring data in the prescribed PDF format.
• Step 4: Pay Renewal Fees — The cost for a CTO depends upon the industrial category (Red, Orange, Green, Blue) and capital investment.
• Step 5: Investigation — The board officials may visit and check pollution control systems and issues Consent to Operate).
