India-UAE CEPA Certification - Process, Fees & Documents

India and the UAE entered into the Comprehensive Economic Partnership Agreement (CEPA) on 18 February 2022, which came into force on 1 May 2022. The agreement aims to enhance bilateral trade and expand export opportunities across key sectors, including oil and gas, petrochemicals and minerals, textiles and apparel, agriculture, jewellery, gems, and metals. It also facilitates the recognition of professional qualifications in fields such as engineering, architecture, healthcare, company secretarial services, and accountancy, supporting the movement of skilled service professionals between the two countries.

CEPA between India and UAE allows traders from both countries to receive preferential treatment and customs incentives when importing various items. The Department of Commerce, Central Board of Indirect Taxes and Customs in India, and the UAE Ministry of Economy are responsible for issuing the India–UAE CEPA Certificate as a Certificate of Origin for preferential treatment. India’s tariff commitments for trade in goods cover 11,908 items, while the UAE covers 7,581 items. Under CEPA, the UAE will reduce tariffs on 97% of its tariff lines, covering 99% of Indian exports by value, with immediate reduction on 80.3% of lines from the date of implementation. The UAE is India's third largest trading partner and India is the UAE's second largest trading partner, with bilateral trade targeting USD 72-100 billion over five years under CEPA.

What is India UAE CEPA Certificate of Origin ?

The India-UAE CEPA Certificate of Origin is an official document that certifies goods exported from India satisfy the Rules of Origin prescribed under the Comprehensive Economic Partnership Agreement. It serves as proof of Indian origin, enabling importers in the UAE to claim preferential reduced or zero duty rates at UAE customs instead of the standard MFN tariff.

The Certificate is issued by authorised agencies in India including the Directorate General of Foreign Trade (DGFT), the Export Inspection Council (EIC), designated Special Economic Zones, and commodity boards such as APEDA. The Department of Commerce and the Central Board of Indirect Taxes and Customs oversee the framework on the Indian side, while the UAE Ministry of Economy administers it on the UAE side.

As per Rule 15(11) of Notification No. 39/2022-Customs (N.T.), the Certificate of Origin must be issued prior to, at, or within five working days of the date of exportation. Once issued, it is generally available within one to two working days.

India –UAE CEPA Certificate of Origin Registration Process

Registration process for India-UAE Comprehensive Economic Partnership Agreement (IUCEPA) involves the following major steps:

  • Account ID Creation: Create an account on DGFT Trade Connect e-platform with a valid digital signature certificate to apply for IUCEPA certificate.
  • Complete Form with Appropriate Details: Fill in the application form accurately with product details including HS Code, FOB value, consignee information, and shipment details along with supporting documents.
  • Upload the Necessary Documents: Attach all mandatory documents including Commercial Invoice, Purchase Bill with raw material origin details, Manufacturer Exporter Declaration, Product Description and Purchase Order from the importer.
  • Verification & Authorization: The issuing agency reviews the submitted documents and application through its risk management system. Based on the risk profile of the exporter or product, a factory visit or physical inspection may be conducted by the authorized agency before approval.
  • Issuance of IUCEPA Certificate: Upon successful verification of the application and payment of applicable fee, relevant authorized issuing agency (EIC, DGFT and concerned SEZ or commodity board) issues the IUCEPA Certificate of Origin valid for 12 months from the date of issuance.

India-UAE CEPA Rules of Origin Requirements

Under the India-UAE CEPA, products are considered originating goods of a party when they meet the applicable Rules of Origin (RoO) prescribed under the agreement.

  1. Wholly Obtained products
  2. Value-added Criteria for products.
  3. Change in Tariff Heading (CTH) product's 4-digit HS code changes during Indian processing
  4. Change in Tariff Sub-Heading (CTSH) product's 6-digit HS code changes during Indian processing
  5. Change in harmonized system (HS) chapter
  6. Final manufacturing before export must be done in the exporting country.
  7. Sharing of detailed products info with authorities to comply with preferential treatment
  8. The Product has undergone sufficient working or production per the Product specific rules (PSR) as agreed by the parties under CEPA.

Note: Non-originating materials failing the CTH/CTSH rule are still permitted if their value does not exceed 10% of the factory/manufacturing price (ex-works price) of the finished product. This tolerance does not apply to Chapters 50–63 (textiles and apparel).

Example: Raw cashew in shell imported from Ivory Coast, HS 0801.31 → Processed cashew kernel exported to UAE, HS 0801.32

Proof of origin:

Eligible exporters can provide Proof of Origin Certificate of the product through any of the following means :

  1. eCoO (Electronic Certificate of Origin): Digitally issued by an authorized agency via the DGFT Trade Connect portal.
  2. Self-Declaration by Approved Exporter: Available to exporters registered as Authorized Economic Operators (AEO) or approved exporters under the CAROTAR 2020 framework (Customs Administration of Rules of Origin under Trade Agreements Rules). Self-declarations must include a signed declaration of origin statement.
  3. A paper certificate of origin of CEPA registration in electronic or hard copy format issued by the authorized government body.

Eligibility of Products Under India-UAE CEPA

Obligations For Exporter Under India-UAE CEPA Agreement

Under the Agreement, the UAE will reduce tariffs on 97% of tariff lines (total tariff lines -7581) that account for 99% of Indian exports in value terms, including the immediate reduction of taxes on 80.3% of lines.

  • The exporter shall submit the minimum required information and supporting documents for the certificate of origin under India UAE cepa or IUCEPA registration.
  • Any exporter falsely representing any material information relevant to the determination of the origin of products shall be liable to prosecution and penalties.
  • Exporters are required to keep minimum information and supporting documents of their products for five years from the expiry date of the CEPA certificate of origin.
  • The exporter shall keep appropriate commercial accounting records for the production supply of the products.
  • The exporter shall notify the issuing authority, customs authority, and the importer of any chances that could affect the accuracy or validity.

Penalties for Non-Compliance Under India-UAE CEPA

Under CAROTAR 2020 framework, Indian customs authorities have the right to verify the origin of imported goods and may suspend preferential treatment if CoO documentation is found inaccurate or fraudulent.

  1. If the certificate of origin establishes the Product's non-compliance, then custom duties shall be levied under the India UAE cepa agreement.
  2. Each Party shall also adopt or maintain measures that provide for the imposition of civil and administrative laws. Where appropriate, it shall implement criminal sanctions for violations of its customs laws.
